FAMILY SPONSORSHIP

Canadian citizens and permanent residents have the option of reuniting with their parents and grandparents through two popular programs: Family Class sponsorship and the Super Visa program. Both programs allow for the sponsorship of parents and grandparents to come to Canada.
The Family Class sponsorship program includes a stream for the sponsorship of parents and grandparents by Canadian citizens and permanent residents. Sponsored parents and grandparents will be granted Canadian permanent residency and will have the opportunity to apply for Canadian Citizenship after four years of living in Canada as permanent residents. This program provides a pathway for parents and grandparents to join their loved ones in Canada and start a new life. It is a popular option for reuniting families in Canada.

To be considered eligible for the Family Class sponsorship program, the sponsor in Canada must fulfill the following requirements:

  •    Must be a Canadian citizen or Permanent Resident
  •    Must be 18 years of age or older
  •    Must meet the minimum necessary income level, combined with spouse's income if married or in a common-law relationship
  •   The sponsor and the sponsored relative must sign a sponsorship agreement which outlines the sponsor's commitment to provide financial support if needed. The agreement also requires the sponsored relative to make efforts to support themselves. Dependent children under 22 are exempt from signing this agreement. Additionally, Quebec residents must sign a binding "undertaking" with the province.
  •   The sponsor must make a promise to offer financial support to the sponsored relative for a span of 20 years starting from the date the sponsored relative obtains permanent residency in Canada.

Sponsors are required to demonstrate that they meet the minimum income requirements in order to sponsor their relative. This can be done by submitting notices of assessment issued by the Canadian Revenue Agency (CRA) to support their sponsorship application. The notices must show that the sponsor has consistently met the minimum necessary income level for three consecutive years. This step is important to ensure that the sponsored relative will not need to rely on social assistance.

SPOUSE SPONSORSHIP

There are some restrictions on Spousal sponsorship’s and on sponsored spouses as well. Please talk to us to discuss your case. We will guide you thoroughly as to how to apply for permanent residence in Canada. Processing time of the application depends on several factors including the country where the application is filed.

One of the most important factors that cause a delay in processing the permanent residence application is missing information and documentation.

We will make sure every application gets the desired attention by our experts and try to prepare a meticulous application so as to ensure that the application is not delayed because of missing or incorrect information. Recently there have been some substantial changes to Spousal visa processing. On one hand, this has made application processing difficult for applicants with fake marriages, on the other hand, there is more reason for genuine applicants to be careful with their applications. Please talk to us to know more about how to become a Canadian resident and your chances of sponsoring your spouse.

The process of spouse/common law partner immigration outside Canada can be broadly categorized into two main divisions. In the first process, the office responsible for processing the application will make sure that the sponsor is eligible to make an application for sponsorship and all the documents are in order. Once this preliminary assessment is complete the application is forwarded to the relevant visa office for the final determination of the application.

If the visa officer requires further information or documentation they can request it or they may decide to call the applicant for a personal interview before a final determination is made on the application. The processing of applications in case of an inside Canada sponsorship will be somewhat different from this above-mentioned processing. The applicant might be able to apply for an open work permit Canada during the process that enables them to work while the application is being processed. Based on your situation our experts will advise you which option you should opt for.
